Apple to face antitrust lawsuit from Alt App Store Maker


Apple Inc. AAPL attempts to file an antitrust lawsuit in Cydia returned have been reduced to nil.

What happened: The Tim CookThe Cydia-led tech giant reportedly argued that Cydia’s claims that it had a monopoly on distributing software on its mobile operating system fell outside the statute of limitations.

The claim was dismissed by the U.S. District Judge of California Yvonne Gonzalez Rogersaccording to a Reuters report.

The amended lawsuit, filed by Cydia, accused Apple of releasing technology updates between 2018 and 2021 that were “overt” acts harming iOS app stores like Cydia.

Gonzalez Rogers ruled that “to the extent that Plaintiff’s claims rely on Apple’s technology updates to prevent Cydia from fully functioning, these claims are timely”.

Why is this important: Cydia is a third-party app store. It can only be used for jailbroken iPhones and iPads. The App Store contains many applications that are not approved by Apple.

Jailbreaking refers to the removal of restrictions put in place by the manufacturer regarding the unauthorized installation of software.

Apple has until mid-June to respond to Cydia, Reuters reported.

Gonzalez Rogers had also dismissed an earlier challenge by Saurik IT LLCwhich developed Cydia, claiming it was out of statute of limitations, but allowed the latter to file a new lawsuit, Reuters noted.

In November, Gonzalez Rogers reprimanded Apple for what she called “nascent antitrust conduct” related to a case involving epic gamesthe creator of “Fortnite“, but decided largely in favor of the iPhone maker.

Epic and Apple had gotten into a legal tangle over in-app payments, which led to Fortnite being removed from the App Store. The two companies are still engaged in a legal battle in the US Ninth Circuit Court of Appeals.

Price action: On Friday, Apple shares closed 4.1% higher at $149.64 in the regular trading session, according to data from Benzinga Pro.
